Exclusion of Cannabis / Hemp Parts from Type 5 Narcotics List

The Ministry of Public Health issued its Notification Re: Specification of Type 5 Narcotics B.E. 2563 (2020) (“Notification”) on 8th December 2020 to exclude certain parts of cannabis and hemp from the Type 5 Narcotics under the Narcotics Act B.E. 2522 (1979) as amended (“NA”).  The Notification was published in the Government Gazette on 14th December 2020 and became effective from 15th December 2020.

The following parts of cannabis and hemp planted by the authorized producers under the NA are now excluded from the Type 5 Narcotic list:-

1.   the rind, stem, fiber, petiole, root, leaf with no treetop or inflorescence of cannabis, its extract with Cannabidiol (“CBD”) and Tetrahydrocannabinol (“THC”) of not more than 0.2% by weight, and the remaining from cannabis extract with THC of not more than 0.2% by weight; and

2.   the rind, stem, fiber, petiole, root, leaf with no treetop or inflorescence of hemp, its extract with CBD and THC of not more than 0.2% by weight, hemp seeds, hemp seed oil, hemp seed extract, and the remaining from hemp extract with THC of not more than 0.2% by weight.

The importation of the parts mentioned above remains subject to the NA, except for the dried rind, dried core of the stem and dried fiber of the cannabis and hemp.
