2022年4月3日，缅甸中央银行(“CBM”)发布了关于外汇兑换的第12/2022号通知(“通知”)和第4/2022号指令(“第4号指令”)。它们于2022年4月3日生效。 2022年4月5日，CBM发布了第6/2022号指令(“第6号指令”)，规定了将外币汇入缅甸、在国外兑换和转移/汇回外币的程序。 通知及指示4和指示6的主要规定概述如下： 通知要求 任何从国外接收外币的缅甸居民必须通过将资金转入在缅甸持有授权经销商执照的银行（“AD银行”）开立的外币账户，将外币汇入缅甸，并在一个工作日内将资金兑换成缅甸元（“MMK”）。2022年4月3日前汇入缅甸的外币也要遵守这项新的外币兑换要求。 任何外汇汇出必须在获得外汇监管委员会(“FESC”)许可的情况下通过AD银行进行。 若不遵守《通知》，将根据《2012年外汇管理法》采取法律行动。 指令要求 每一家AD银行都必须遵守外币兑换要求及实施措施和政策。 CBM 规定的美元兑换汇率为每美元 1,850 缅甸元。其他外币按1美元兑1,850缅甸元的汇率计算。 自2022年4月4日起，在贸易和非贸易活动(如货物出口、服务提供、不受FESC批准豁免的投资资金)，并存入AD银行开立的银行账户，必须在收到之日起一个工作日内按照CBM规定的汇率折算成缅甸元。 在接受并记入相关银行账户中收到的每一笔资金转账作为离岸贷款、投资基金或单边资金转账之前，相关AD 银行必须核实该资金是否已获得CBM 的批准。 缅甸居民必须获得FESC的批准，然后才能将外币资金转移到国外，用于支付进口商品、服务、支付股息、资本投资支付、偿还贷款等。 AD 银行可以对每笔资金转账收取每美元 3 缅甸元的银行服务费。 豁免 2022年4月20日，CBM发布了第FE 1/69豁免某些活动和人员在《通知》下将从国外收到的外汇存入AD银行并根据《通知》将其转换为缅甸元的要求如下: 缅甸投资委员会（“MIC”）许可下的外国直接投资活动。 在经济特区(“SEZ”)经营的商业投资。 驻缅甸大使馆的外国外交官及其家属。 外交单位中与外国使馆外交人员同级的外国工作人员。 联合国组织(“联合国”)及其机构的工作人员，以及持有联合国工作人员(通行证)护照的缅甸国民。 协助缅甸的外国发展机构的外国工作人员。 在国际组织(如红十字国际委员会、国际劳工组织、国际非政府组织)和发展机构(如TICA、JICA)工作的外交级别的外国工作人员 国家和缅甸公民拥有的国际航空公司。 To see the archive of our past newsletters and articles please click here.
